I wanna set up the following wonderful article by POWERLINE with the latest “Constitutional Crisis” in the iteration of them in the Left’s eye. NEWSBUSTERS has this:

As far back as 2017, the media were seeing constitutional crises around every corner. Nancy Pelosi once remarked in 2019 that Trump had triggered one, and the cable (CNN, MSNBC) and broadcast (ABC, CBS, NBC) networks eagerly parroted that claim 386 times in five days.

The journalists are very frustrated that nobody’s taking their protestations seriously anymore. But it was their own overuse of the term that caused it to lose whatever potency it once had. After all, what does a journalist really expect of you when he bursts into your bedroom at 11 p.m., sobbing about the constitutional crisis lurking under his bed? And really, what can you  do — except get him a glass of water, tuck him back in, and make a show of checking under his bed before you return to your room? ….

[….] In my view, we are indeed experiencing a constitutional crisis. But it is not the one the Democrats have in mind. For President Trump to assert control over the executive branch is not only proper, it is long overdue. Under Article II of the Constitution, the President doesn’t just run the executive branch. He is the executive branch. All employees of federal agencies are members of the executive branch, and as such, ultimately report to the president. Their job is to carry out his policies.

The fact that this, to many, is not self-evident illustrates the real constitutional crisis that we face–the slow-moving crisis that has been underway now for close to a century. That crisis is the growth of the administrative state, the fourth branch of government that is mentioned nowhere in the Constitution. There is a strong argument that the administrative state is unconstitutional. What is incontrovertibly unconstitutional is the concept of an executive branch that is independent of the president.

But that is exactly what the Democrats want–a fourth branch that is not accountable to the president, but for which, at the same time, Congress need not take responsibility. Take the case of USAID. Trump and his minions have brought to light that USAID has been spending money on a transgender opera in Colombia, a transgender comic book in Peru, and so on. Beyond such obviously inappropriate expenditures, it has also come to light that USAID functions largely as a slush fund for politically-connected NGOs. Thus:

Since 2010, USAID has disbursed at least $2.13 billion in contracts and grants for Haiti-related work. Overall, just $48.6 million has gone directly to Haitian organizations or firms, just over 2 percent. Comparatively, more than $1.2 billion has gone to firms located in DC, Maryland or Virginia.

So what is the Trump administration supposed to do when it finds that an executive branch agency is wasting money, engaging in corrupt practices, or spending resources in ways that actually undercut the administration’s policies? According to the Democrats, nothing. Once Congress has appropriated money to USAID or any other agency, the Trump administration has no option but to spend it–and, apparently, to spend it in the ways that the unelected bureaucrats in that agency choose.

Of course, if you look at the appropriations bill that covers USAID, you will see no reference to transgender operas. Nor will the phrase “transgender comic book” appear. USAID’s funding is allocated in broad categories that sound noble. But where the money actually goes, Congress has no idea.

Secretary of State Marco Rubio has talked about this. When he was in the Senate he tried to exercise oversight over USAID. Employees of that agency would appear before his committee, and he would ask them how money is a particular category was being spent. Where is this money going? Who is being paid, and for what purpose? And the USAID witnesses would refuse to answer. They didn’t have to say; they were independent.

That is a constitutional absurdity and a policy outrage. And it also is one of the reasons why Democrats love the fourth branch. They use vague appropriations to enable spending for which they would never want to take responsibility. Can you imagine a Democratic House member trying to explain to constituents why he voted to fund a transgender opera in a foreign country? But no such explanation ever becomes necessary. The fourth branch is shrouded in secrecy and “independence.”

If you take seriously the fact that the President runs the executive branch–indisputable, under Article II–then, if the president learns that money is being wasted, that an agency has gone rogue, that its officials are pursuing policies that contradict those of the administration they serve–the president’s duty is to stop it. Stop the spending, fire the employees, neuter the rogue agency.

Of course it is true, as the Democrats say, that the President doesn’t have the power to abolish an agency that Congress has created. Thus, for example, President Trump cannot, by executive order, abolish the Department of Education. But he can run the Department of Education, and if that department is spending resources in ways that are wasteful or that contradict his administration’s policy goals, he can stop or redirect that spending.

The Democratic Party press has the current crisis exactly backward. The fact that President Trump is asserting control over the federal employees who work for him is a natural, if long-overdue, return to constitutional norms. The idea that the executive branch is somehow beyond the control of the president is the real crisis, one that has been long in the making. Ultimately, the Supreme Court will sort out the respective powers of Congress and the President with regard to the agencies that are established by Congress. In the meantime, President Trump needs to continue to assert his constitutional responsibility for the executive branch.

Israel Declared War… Day 2

POWERLINE:

  • Hamas’s 10/7 attack is something like Israel’s 9/11, only worse. Israel’s death toll has hit more than 350. Adjusting for population and measuring by the deaths inflicted so far, Israel has suffered (is suffering) an attack that is something like three times more damaging than 9/11.
  • Hamas is a genocidal terrorist organization. It is waging war by atrocity, as it always does. The fire this time should be its last.
  • As I write on 10/8, Hamas’s attack continues and deaths mount. Israel seems not yet to have concluded the fighting on its own territory.
  • The Israeli intelligence, defense, and political establishments were caught napping. The complete failure of intelligence is comparable to the one that preceded the Yom Kippur War 50 years ago.
  • Speaking of the Yom Kippur war, we can infer that the attack was timed to coincide with its 50th anniversary. Given the planning and preparation that preceded the attack, disruption of Israel’s possible peace with Saudi Arabia must constitute an added benefit rather than its immediate object.
  • By comparison with the Yom Kippur War, it seems to me that the consequences of this war are more dire and the effects more difficult to contemplate. Last night Prime Minister Netanyahu declared that Hamas would be destroy Hamas’s military and governmental capabilities. What happens next?
  • Hamas has taken numerous hostages and removed them to Gaza. The Israeli embassy to the United States is reporting that 100 soldiers and civilians have been kidnapped. So long as Hamas holds these hostages, it will necessarily constrain Israel’s freedom of action to achieve its stated objectives, as does Israel’s meticulous compliance with the laws of war. The IDF is not free to combat savagery with savagery.
  • As Elliott Abrams puts it at NRO: “There is no way around the fact that Hamas has new assets and that future negotiations over the captured Israelis will be excruciating. That is one reason a government of national unity is called for — to stop opposition parties from politicizing tough decisions by making them partly responsible for Israeli policy in the coming months.”
  • Hezbollah aggravates Israel’s military challenge at present. Their forces and their arsenal exceed Hamas and hold Lebanon in thrall.
  • The intelligence and readiness failures underlying Yom Kippur War brought down the government of Prime Minister Golda Meir. The government of Prime Minister Benjamin Netanyahu faces the same after a commission of inquiry does its work.
  • Iran is of course behind this war: Hamas spokesman Ghazi Hamad tells the BBC that Iran gave its support to the Palestinian terror group to launch its surprise multi-front attack on Israel on Saturday. Yet the Biden administration remains in doubt about that.
  • Which raises the question of our own failure of intelligence. Thus spake National Security Advisor Jake Sullivan only a few days ago. This didn’t age well. Unfortunately, these people are incapable of shame.

Like POWERLINE….

  • When a country is attacked, the only appropriate course is to respond with massively disproportionate force, as we did against the Japanese in World War II. Israel should treat Gaza as the Allies treated Dresden and other German and Japanese cities to end that war. Israel made a mistake in withdrawing from Gaza, and Gaza has been a thorn in its side ever since. This should be the last time.

Not only that, but you know there are non-thinking Lefties in the Biden administration’s Office of Palestinian Affairs when they deleted a post advising Israel not to retaliate after Saturday’s massive attack by the Islamist group Hamas, according to multiple reports.

The United States’ Office for Palestinian Affairs has deleted a post from their X account that called for Israelis to “refrain from violence and retaliatory attacks” in response to Hamas attacking Israel.

The post on X had said “We unequivocally condemn the attack of Hamas terrorists and the loss of life that has incurred. We urge all sides to refrain from violence and retaliatory attacks. Terror and violence solve nothing.”

Of course the anti-Israel schills on the media (MSNBC, CNN) are saying the quite part out load. But the DEMOCRAT SOCIALISTS OF AMERICA take the cake (BREITBART):

The Democratic Socialists of America (DSA) will host an “All Out for Palestine” rally in New York’s Times Square on Sunday, gathering in the wake of the Hamas terrorist attack on Israel that has claimed more than 500 lives and left several thousand more injured.

THE NEW YORK POST notes that the organizers are telling people “Wear a mask so you’re not recognized.” Kinda like the KKK. They go on to rightly note that “The DSA is the party of Ilhan Omar, Cori Bush, Rashida Talib — and oh yes, New York’s very own Alexandria Ocasio-Cortez and Jamaal ‘Fire Alarm’ Bowman.” RED STATE has a good post on this, and put the onus on these far-Left Democrats in office:

In case that isn’t clear, they’re not advising wearing a mask for COVID protection; they’re advising masks and not posting pictures so they can’t be identified by the police when the “action” starts to go potentially criminal. 

So here’s a good question for reporters: Ask AOC and her other DSA-associated brethren in Congress their opinion on this “action” by the DSA. Put them on the spot and hold them accountable for such actions. Ask if they will renounce this group that is now explicitly supporting such attacks. I doubt you will get any kind of honest response. Many people called out the association with the Democrats and called out this “protest.”

Ambassador Bill Taylor’s LAUGHABLE “Testimony” (UPDATED)

The media went with the Democrats summary of the witness testimony — so the media [in other words] didn’t report just how horrible the witness was. As usual, it took a couple minutes to cut through the muck by a Republican. TWITCHY notes some of the devastating “fact” witness B.S.

The “Whistleblowers” name appears in both the Mueller Report (PUBLIC ACCESS) and released PUBLIC documents by Schiff. And, he is not a whistleblower.  The statute does not say anywhere in it that a name cannot be released. It merely protects a whistleblower from being fired arbitrarily or having work-place harassment from happening. Second, the “blower” did not mention anything to do with intelligence from his community. He passed along (leaked) 3rd-hand information.

More Lies From Shifty Schiff’s Witnesses

(DAILY CALLER) Fox News host Tucker Carlson reported Thursday night on email evidence that President Barack Obama’s Ambassador to Ukraine, Marie Yovanovitch, may have perjured herself under oath.

NOQ has this:

A lie is only a lie if you get caught. Otherwise, it’s treated in the same regard as the truth, especially regarding sensitive issues such as the impeachment inquiry. We’ve already seen a flurry of lies coming from Adam Schiff and his office, including the strangely-suppressed whopper that he repeated multiple times, saying he didn’t know who the Ukraine whistleblower was. We later learned through leaks that he not only knew the whistleblower but actually consulted with him before the complaint was filed.

But the latest lie appears to be even more significant, not based on the lie itself but the situation surrounding it. Tucker Carlson’s team learned President Obama’s Ambassador to Ukraine, Marie Yovanovitch, appears to have perjured herself under oath when asked about an email from a Democratic congressional staffer. The email was seeking a meeting to discuss information that would eventually become the basis for the impeachment inquiry. When asked if she responded to the email by Representative Lee Zeldin (R-NY), she said she didn’t.

This turned out to be a lie.

Here’s the content of the email:

According to Carlson, Yovanovitch replied, “looked forward to chatting with you.”

The apparent perjury is big, but what’s more important is this reveals Democrats were well aware of the contents of the whistleblower complaint over a month before the public was made aware.
